AIHW analyst portal access conditions
The following terms and conditions apply to accessing and using the AIHW analyst portal (the Portal). In accessing and using the Portal you agree to be bound by these terms and conditions.
If you do not accept these terms and conditions, you must refrain from accessing and using the Portal. If you continue to access and use the Portal, you will be deemed to have accepted these terms and conditions.
The AIHW may modify these terms and conditions at any time, and such modifications will become effective immediately upon posting the modified terms and conditions on the Portal. Any use of the Portal by you after such time will be deemed acceptance by you of those modified terms and conditions.
- Your access and use of the Portal is attached to a unique email address for approved users with password protection and multifactor authentication (Login Information). You must not disclose your Login Information to any person or otherwise allow any person to access the Portal.
- Your access and use of the Portal must be in accordance with the terms and conditions of the deed of confidentiality (or equivalent), or the deed of user undertaking (or equivalent) signed by you and is only for the purposes of carrying out the duties of your current professional role. You must inform the AIHW via [email protected] as soon as practicable, if there is a change to your professional role or organisation.
- You must not access or use the Portal for any purpose that is unlawful or prohibited by these terms and conditions.
- Data or information within the Portal is only to be used for its intended purpose; and must be within the permitted use or permitted purpose(s) as set out in the deed of confidentiality (or equivalent), or the deed of user undertaking (or equivalent) signed by you.
- Data, information, forecasts or conclusions gathered from data or information within the Portal is not for public comment and must not be shared outside of your organisation without the prior written approval of the AIHW.
- The AIHW acquires and holds information which is "health-related information and statistics" or "welfare-related information and statistics" as defined in the Australian Institute of Health and Welfare Act 1987 ("the AIHW Act"), and that such information and statistics are subject to the provisions of section 29 of the AIHW Act. By accessing and using the data or information within the Portal, you may become an "informed person" within the meaning of section 29 of the AIHW Act. Criminal penalties apply for improperly divulging or communicating such information and statistics. See further information about section 29 of the AIHW Act and the AIHW Data Governance Framework.
- You must take your own precautions to ensure that the process which you employ to accessing and using the Portal does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. The AIHW does not accept responsibility for any interference or damage to your own computer system which arises in connection with your use of the Portal.
Indemnity
- You indemnify the AIHW and its affiliates, partners, employees and agents against all actions, claims and demands (including the cost of defending or settling any action, claim or demand) which may be instituted against the AIHW arising out of a failure, by you or by any person using your Login Information (whether or not you have authorised that person to use your Login Information), to comply with these terms and conditions.
Privacy
- The AIHW acquires and holds information that is "Personal Information" as defined in section 6(1) of the Privacy Act 1988 (the Privacy Act), and such information is managed in accordance with:
• Australian Privacy Principles in the Privacy Act, and
• the Guidelines for the Protection of Privacy in the Conduct of Medical Research, approved from time to time by the Privacy Commissioner under section 95 of the Privacy Act.
Protective Security Policy Framework
- Your access to the AIHW Analyst Portal is dependent on your compliance with any relevant requirements of the Australian Government Protective Security Policy Framework. You can obtain further information in relation to the Australian Government Protective Security Policy Framework on the Commonwealth Attorney-General's Department Website.
Termination of Access
- Breaching these terms and conditions may result in your access to the Portal being terminated and the notification of such breach to your CEO/Agency head.
Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of the Australian Capital Territory.
